Intellectual Property Policy

Binged Shop respects intellectual property and expects the same from others. All of our designs and characters are original works created for this brand. If you believe material on binged.shop infringes a copyright or other right you hold, this policy explains how to notify us and how the process works.
1. Our designs are original works
Every Binged Shop design, illustration, and character is an original work created for this brand. We build around an aesthetic and our own creativity, not around anyone else's protected property. We welcome good-faith intellectual property concerns and take them seriously.
Important: intellectual property notices should come to us directly through the channel below — not through our payment processor, fulfillment partner, or other vendors, who cannot act on takedown requests on our behalf.
2. Designated agent for notices
We have designated an agent to receive notices of claimed infringement. Send all takedown notices and counter-notices to info@binged.shop with the subject line “IP Notice.” This is the correct and fastest route for any copyright or trademark concern.
3. How to submit a takedown notice
If you are a rights holder or authorized to act for one, please send a written notice to info@binged.shop that includes all of the following:
- Identification of the copyrighted work or other intellectual property you claim has been infringed;
- Identification of the allegedly infringing material, including the specific product page or URL and enough detail for us to locate it;
- Your contact information — name, mailing address, telephone number, and email address;
- A statement that you have a good-faith belief that the disputed use is not authorized by the rights holder, its agent, or the law;
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the rights holder or authorized to act on the rights holder's behalf;
- Your physical or electronic signature.
A notice missing these elements may not be actionable, so please include them all. Submitting a knowingly false claim of infringement may expose you to liability.
4. What we do when we receive a valid notice
When we receive a notice that includes the required information, we will review it promptly and, where appropriate, remove or disable access to the material and notify the person who posted or is responsible for it. We may also contact you for clarification. We act in good faith and do not treat removal as an admission of wrongdoing by anyone.
5. Counter-notice procedure
If you believe material of yours was removed by mistake or misidentification, you may send a counter-notice to info@binged.shop. Please include:
- Identification of the material that was removed and the location where it appeared before removal;
- Your name, mailing address, telephone number, and email address;
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification;
- Your consent to the jurisdiction of the appropriate court, and your agreement to accept service of process from the party who filed the original notice;
- Your physical or electronic signature.
Where the law provides for it, we may restore the material after the applicable waiting period unless the original complainant notifies us that they have filed a legal action.
6. Repeat-infringer policy
We maintain a policy of terminating, in appropriate circumstances, the access or removing the content of anyone who is found to be a repeat infringer. We reserve the right to remove any material and to refuse service for conduct we reasonably believe infringes the rights of others.
