Terms of Service

Binged Shop is an independent retailer. Our collections are organized by aesthetic and mood only — we are not affiliated with, endorsed by, or associated with any celebrity, brand, show, studio, or franchise. Product names describe the item, never a person.

In these Terms, "Binged Shop," "we," "us," and "our" refer to Binged Shop, the operator of the store at binged.shop. "You" refers to the person accessing the site or placing an order. Questions about these Terms can be sent to info@binged.shop.

You must be able to form a legally binding contract to place an order, and you must provide accurate, current, and complete information at checkout. We sell to individual consumers for personal use, not for resale, unless we have agreed otherwise in writing.

We do not require you to create a password-protected account. Orders are tracked through a private, signed link sent to the email address you provide, so it is your responsibility to keep that email account secure and accessible.

Our products are sourced from and shipped by third-party suppliers after you order. Product photography and swatches are representations only; slight variations in color, finish, and packaging between the photos and the item you receive are normal and are not defects.

We try to describe products accurately, but we do not warrant that product descriptions, pricing, or other content is error-free. If an item is listed at an incorrect price or with incorrect information, we may cancel the affected order and refund you in full.

All prices are shown in US dollars and exclude any taxes, duties, or shipping unless stated at checkout. Submitting an order is an offer to buy; it does not by itself create a binding contract.

Order acceptance occurs when an order is fulfilled and shipped, not when payment is taken. Charging or authorizing your payment method is part of processing your offer and does not constitute acceptance. Until your order ships, we may decline or cancel it — for example, for suspected fraud, stock or production issues, or pricing errors — and if we do, we will refund any amount already collected.

Payments are processed by our payment processor. You authorize us and our processor to charge your chosen payment method for the total shown at checkout.

Shipping timelines, our defect policy, and statutory withdrawal rights are described in our Shipping Policy and Returns & Refunds pages, which are incorporated into these Terms by reference. Because orders are sent to our supplier for dispatch quickly, they cannot always be changed or cancelled after they are placed; contact info@binged.shop as soon as possible if you need help.

All content on the site — including the Binged Shop name, logos, artwork, designs, characters, illustrations, graphics, text, and the arrangement of the site — is owned by us or our licensors and is protected by copyright, trademark, and other laws. All Binged Shop designs and characters are original works created for this brand.

We grant you a limited, personal, non-exclusive, non-transferable license to view the site and to use products you lawfully purchase for personal, non-commercial purposes. You may not copy, reproduce, resell, distribute, or create derivative works from our content or designs, or use them to train machine-learning models, without our prior written permission.

If you believe content on the site infringes your intellectual property, our notice-and-takedown procedure is set out in our Intellectual Property Policy.

When using the site, you agree not to:

• break any applicable law or infringe the rights of others;
• attempt to gain unauthorized access to the site, other users' data, or our systems;
• interfere with or disrupt the site, including by introducing malware, scraping at scale, or overloading our infrastructure;
• use the site to commit fraud, launder money, or make purchases you are not authorized to make;
• reverse engineer, copy, or resell any part of the site or its content except as expressly permitted.

We may suspend or terminate access for anyone who violates these Terms or misuses the site.

The site and products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms limits any rights you have under mandatory consumer-protection law, including statutory rights that cannot be waived.

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the site or products. Our total liability for any claim relating to an order is limited to the amount you paid for that order.

[Governing law: to be set upon LLC formation]. Until the governing jurisdiction is finalized, disputes will be handled in good faith under the laws that ultimately apply to the operating entity.

Optional arbitration clause: Where permitted by law, you and we agree that any dispute that cannot be resolved informally may, at either party's election, be resolved by binding individual arbitration rather than in court, and each party waives any right to a jury trial or to participate in a class action. This clause does not apply where prohibited, and it does not deprive consumers of any non-waivable right to bring a claim in their local courts or to pursue small-claims relief. We may update these Terms from time to time. When we do, we will change the “last updated” date above, and material changes take effect when posted. Your continued use of the site after an update means you accept the revised Terms. The version in force at the time you place an order governs that order.
